FlagPilot Terms of Service

Welcome to FlagPilot("FlagPilot", "we", "our", or "us").

These Terms of Service ("Terms") govern your access to and use of the FlagPilot website, dashboard, APIs, SDKs, CLI, MCP server, documentation, and all related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use the Service.

If you use FlagPilot on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

FlagPilot is a feature flag management platform that enables developers and organizations to:

• Create and manage feature flags
• Perform percentage rollouts
• Target specific users
• Evaluate feature flags through SDKs
• Integrate using APIs
• Automate workflows using the CLI and MCP Server
• Monitor feature flag activity
• Configure webhooks
• Manage projects and environments

FlagPilot is intended for software development and deployment workflows.

You must be at least 16 years old or the legal age of majority in your jurisdiction to use the Service.

You may not use the Service if:

• Your use would violate applicable laws.
• You are prohibited from receiving the Service under applicable sanctions or export laws.
• Your account has previously been suspended or terminated by us.

You are responsible for:

• maintaining the confidentiality of your account credentials;
• all activity occurring under your account;
• providing accurate and current account information;
• securing your devices and authentication credentials.

You must notify us immediately if you suspect unauthorized access to your account.

Your account may contain one or more projects.

Each project may contain:

• environments
• feature flags
• API credentials
• SDK credentials
• webhook configurations
• audit history
• integrations
• project members

You are responsible for managing access to your projects and ensuring that only authorized users are granted access.

FlagPilot provides two categories of credentials.

You agree not to:

• violate applicable laws;
• attempt unauthorized access to the Service;
• interfere with Service availability;
• distribute malware;
• perform denial-of-service attacks;
• reverse engineer the Service except where permitted by law;
• exploit security vulnerabilities;
• misuse APIs beyond documented limits;
• use the Service for unlawful or fraudulent purposes.

FlagPilot supports feature targeting using opaque identifiers.

You agree that:

• you have the legal right to submit Target User identifiers;
• you will not intentionally use sensitive personal information as Target User identifiers;
• you are responsible for complying with applicable privacy laws regarding your own end users.

FlagPilot does not attempt to identify the individuals represented by Target User identifiers.

You retain ownership of the content and data you upload to the Service.

This includes:

• feature flags
• project settings
• rollout configurations
• Target User identifiers
• webhook configurations
• audit history
• documentation
• project metadata

You grant FlagPilot a limited license to process this data solely to provide and improve the Service.

We strive to provide a reliable service but do not guarantee uninterrupted availability.

The Service may be unavailable because of:

• maintenance
• software updates
• infrastructure failures
• third-party outages
• security incidents
• force majeure events

We may modify, suspend, or discontinue portions of the Service at any time.

Some functionality may be marked as:

• Beta
• Preview
• Experimental
• Early Access

Beta features are provided "as is" and may:

• change without notice;
• contain bugs;
• be incomplete;
• be removed.

Beta features may not be covered by any service commitments.

Your subscription plan may include limits such as:

• projects
• feature flags
• evaluations
• team members
• webhook deliveries
• API requests

Exceeding plan limits may result in:

• usage notifications;
• feature restrictions;
• billing adjustments;
• temporary rate limiting.

We will make reasonable efforts to notify you before significant restrictions are applied.

Paid subscriptions renew automatically unless canceled.

By purchasing a subscription, you authorize our payment provider to charge the applicable fees.

Prices may change with reasonable prior notice.

Applicable taxes may be added where required by law.

Failure to pay may result in suspension or termination of the Service.

Refunds are provided in accordance with the policies of our payment provider and applicable law.

Unless otherwise required by law or stated in writing, subscription fees are generally non-refundable.

FlagPilot, including its software, APIs, SDKs, documentation, branding, logos, and website, is protected by intellectual property laws.

Except as expressly permitted, you may not:

• copy;
• modify;
• distribute;
• sublicense;
• sell;
• reverse engineer;
• create derivative works.

Nothing in these Terms transfers ownership of our intellectual property to you.

Certain components of the Service may include open-source software.

Such components remain governed by their respective open-source licenses.

If you provide feedback, suggestions, or feature requests, you grant FlagPilot a perpetual, worldwide, royalty-free license to use, modify, and incorporate that feedback without compensation.

The Service integrates with third-party providers.

These may include:

• authentication providers;
• payment processors;
• analytics services;
• monitoring services;
• hosting providers;
• communication platforms.

We are not responsible for the availability, security, or policies of third-party services.

We implement reasonable technical and organizational security measures.

However:

• no system is completely secure;
• you are responsible for securing your own credentials;
• you should rotate compromised keys immediately.

Your use of the Service is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, store, and disclose information.

We may suspend or restrict access if:

• these Terms are violated;
• payment fails;
• suspicious activity is detected;
• the Service is abused;
• required by law.

Suspension may occur without prior notice where necessary to protect the Service or other users.

You may terminate your account at any time.

We may terminate or suspend accounts for violations of these Terms.

Following termination:

• your access will end;
• subscriptions may be canceled;
• data may be deleted in accordance with our Privacy Policy and retention obligations.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLAGPILOT DISCLAIMS ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY;
• FITNESS FOR A PARTICULAR PURPOSE;
• NON-INFRINGEMENT;
• UNINTERRUPTED SERVICE;
• ERROR-FREE OPERATION.

We do not guarantee that feature flags will prevent deployment failures or production incidents.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

FLAGPILOT SHALL NOT BE LIABLE FOR:

• INDIRECT DAMAGES;
• INCIDENTAL DAMAGES;
• CONSEQUENTIAL DAMAGES;
• LOSS OF PROFITS;
• LOSS OF BUSINESS;
• LOSS OF DATA;
• LOSS OF GOODWILL.

OUR TOTAL LIABILITY ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO FLAGPILOT DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain liability limitations. Those limitations apply only to the extent permitted by applicable law.

You agree to defend, indemnify, and hold harmless FlagPilot and its affiliates, officers, employees, and contractors from claims arising from:

• your misuse of the Service;
• your violation of these Terms;
• your violation of applicable law;
• your infringement of third-party rights.

You agree to comply with all applicable export control and sanctions laws.

You may not use the Service in violation of such laws.

FlagPilot is not liable for delays or failures caused by events beyond our reasonable control, including:

• natural disasters;
• war;
• terrorism;
• labor disputes;
• internet outages;
• cloud provider failures;
• governmental actions.

We may improve, modify, replace, or discontinue features at any time.

Where practical, material changes affecting customers will be communicated in advance.

We may update these Terms periodically.

The "Last Updated" date indicates the latest revision.

Material changes may be communicated through:

• email;
• dashboard notices;
• website announcements.

Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

These Terms are governed by the laws of India, without regard to conflict of law principles.

Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiations.

If a dispute cannot be resolved informally, it shall be submitted to the courts located in India, unless applicable law requires otherwise.

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.

These Terms, together with the Privacy Policy and any additional agreements expressly incorporated by reference, constitute the entire agreement between you and FlagPilot regarding the Service.

For the purposes of these Terms:

• Account means a registered FlagPilot user account.
• Client SDK Key means the public credential used by browser SDKs.
• Secret API Key means the confidential credential used by server-side SDKs.
• Feature Flag means a configurable rule controlling application behavior.
• Project means a logical container for environments, feature flags, and settings.
• Service means the FlagPilot platform and all related products.
• Target User means an opaque identifier configured for feature targeting.
• User means any person or entity accessing or using the Service.
